Not Immigration News — Here's What This Actually Is
This Federal Register notice from the Pipeline and Hazardous Materials Safety Administration (PHMSA), published December 5, 2025, has nothing to do with US immigration policy, visa categories, or international students and workers. It is an administrative hazardous materials notice.
Key Points
- What: PHMSA granted 12 special permits allowing companies to transport hazardous materials under conditions that deviate from standard DOT regulations.
- Who: Private companies including Tesla, SpaceX, SodaStream, and others handling lithium-ion batteries, compressed gases, radioactive materials, and explosives.
- When: Comments must be received on or before January 5, 2026.
- Impact: No impact on visa holders, immigration status, or international students.
What This Notice Actually Covers
PHMSA periodically publishes notices of actions taken on special permit applications — essentially company-by-company exemptions from standard hazardous materials transport rules (49 CFR).
Among the permits granted:
- Tesla received a permit to transport damaged, defective, or recalled lithium-ion batteries in non-compliant packaging.
- SpaceX was authorized to use a contract carrier to transport unapproved explosives for developmental rocket testing.
- Veolia ES Technical Solutions was cleared to transport damaged or recalled lithium-ion batteries for disposal.
- K2 Space Corporation received approval to ship compressed krypton cylinders integrated into spacecraft.
- Thales Alenia Space Italia had an existing permit modified to allow prototype lithium-ion batteries over 35 kg on cargo aircraft.
Three applications were withdrawn — by Allendale LLC, D-Orbit US LLC, and Honda Racing Corporation USA — and no applications were denied.
